1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Namma Ashram Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at Brigade Lakefront, Mahadevapura, Bangalore, 560048 (CIN: U11049KA2024PTC186562) (the "Company", "we", "us", "our"), which owns and operates the website thecuriotable.in and associated digital platforms (collectively, the "Platform") and trades under the brand "The Curio Table & Namma Ashram" (the "Brand") from its venue at Curiouscity Science Center, Kachamaranahalli, Thigala Chowdadenahalli, Sarjapur Road, Bengaluru, Karnataka 562125 (the "Venue").
By accessing or using the Platform, browsing our menus or event listings, creating an account, or making a Booking, you agree to be bound by these Terms, our Privacy Policy, and the specific terms applicable to the Service you book (described in Section 5). If you do not agree, please discontinue use of the Platform.
2. Definitions
"Services" means table reservations, event and workshop tickets, games and activity bookings, memberships, gift vouchers, and any other product or service offered through the Platform or at the Venue. "Booking" means any reservation, ticket purchase, registration, or order. "Content" means all text, graphics, images, logos, menus, designs, and other material made available on the Platform. "User Content" means any review, comment, photograph, or other material submitted by a User.
3. Eligibility
You must be at least 18 years of age and capable of entering into a binding contract under the Indian Contract Act, 1872 to make a Booking or transact on the Platform. Individuals under 18 may use the Platform only under the supervision of, and with transactions completed by, a parent or lawful guardian. Services that are restricted by law to individuals above a certain age, including the service of alcohol (restricted to persons 21 years of age or older in Karnataka), remain subject to such age restrictions regardless of who completes the Booking.
4. Account Registration
Where the Platform requires you to create an account, you agree to provide accurate, current, and complete information, to maintain the confidentiality of your login credentials, and to notify us promptly of any unauthorised use of your account. You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate an account that provides false information, is used fraudulently, or is used in breach of these Terms.
5. Scope of Services and Specific Terms
The Platform allows you to discover and book table reservations, event and workshop tickets, games and activity slots, memberships, and related Services. In addition to these Terms, your Booking is governed by the following document(s) applicable to the relevant Service, each of which is incorporated into these Terms by reference and is available on the Platform: the Reservation & Dining Terms (for table bookings); the Event / Workshop / Ticketing Terms (for event, workshop, games, and activity bookings); and the Refund & Cancellation Policy (for all Services). Where there is a conflict between these Terms and a specific document listed above in relation to a particular Booking, the specific document shall prevail to the extent of such conflict.
6. License to Use the Platform; Restrictions
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform solely to browse our offerings and make Bookings for personal, non-commercial use. You agree not to: scrape, harvest, or extract data from the Platform using automated means; use bots or automated scripts to make or attempt Bookings; reverse engineer, decompile, or attempt to extract the source code of the Platform; frame or mirror any part of the Platform without our written consent; introduce malware, viruses, or any code intended to disrupt the Platform; or circumvent or attempt to circumvent any security or access-control measure on the Platform.
7. Intellectual Property
All Content on the Platform, including the name and marks "The Curio Table," "Namma Ashram," and "The Curio Table & Namma Ashram," our logo, menu design, photography, and the look and feel of the Platform, are the exclusive property of the Company or its licensors and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in such Content, except the limited licence in Section 6. You may not reproduce, distribute, modify, or create derivative works from any Content without our prior written consent. The Company reserves the right to take action, including legal action, against any unauthorised use of its name, marks, or Content, including any deceptively similar mark or trade name.
8. User Content
Where the Platform permits you to submit reviews, photographs, comments, or other User Content, you grant the Company a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, adapt, publish, and display such User Content for the purpose of operating, promoting, and marketing the Brand, across the Platform and our social media channels. You represent that you own or have the necessary rights to the User Content you submit and that it does not infringe any third party's rights or violate any applicable law. We reserve the right, but not the obligation, to review, moderate, edit, or remove any User Content at our sole discretion, including content we consider defamatory, obscene, misleading, or otherwise objectionable.
9. Prohibited Conduct
You agree not to: make a Booking using fraudulent, fictitious, or another person's identity or payment details; engage in any conduct that constitutes payment fraud or attempts to defraud the Company or any Payment Partner; resell or transfer tickets in breach of the Event / Workshop / Ticketing Terms; harass, threaten, or behave abusively towards our staff, facilitators, or other guests; or use the Platform in violation of any applicable law, including the Information Technology Act, 2000.
10. Pricing, Availability, and Errors
Prices displayed on the Platform are stated in Indian Rupees and, unless expressly stated otherwise, are inclusive of applicable Goods and Services Tax (GST). Menus, event line-ups, ticket inventory, and pricing are subject to change without notice prior to a confirmed Booking. In the event of a pricing, descriptive, or typographical error on the Platform, including in respect of a Booking already confirmed, we reserve the right to correct the error, and where a Booking was accepted on the basis of an erroneous price, to cancel that Booking and refund any amount already paid, or to contact you to confirm whether you wish to proceed at the correct price.
11. Third-Party Services
Payments made through the Platform are processed by an RBI-authorised Payment Aggregator engaged by us ("Payment Partner"). Your payment transaction is also subject to the Payment Partner's own terms and privacy policy. While we select our Payment Partner with reasonable care, we are not liable for any act, omission, delay, security incident, or service failure on the part of the Payment Partner that is beyond our reasonable control, save as required by applicable law.
12. Disclaimer of Warranties
The Platform and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. Descriptions, images, and content relating to menus, events, workshops, and experiences on the Platform are indicative and may vary in actual presentation, availability, ingredients, or execution. Any health, wellness, dietary, or similar content on the Platform is provided for general informational purposes only and does not constitute professional or medical advice. Nothing in this Section limits any right or remedy available to you as a "consumer" under the Consumer Protection Act, 2019 that cannot lawfully be excluded.
13. Limitation of Liability
To the maximum extent permitted by applicable law, and regardless of whether a claim is brought in contract, tort (including negligence), strict liability, or otherwise, the Company's aggregate liability arising out of or in connection with a Booking shall not exceed the amount actually paid by you for that specific Booking. In no event shall the Company be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profit, loss of opportunity, loss of data, or reputational harm, arising out of or in connection with the Platform or the Services, even if advised of the possibility of such damages. This limitation applies to the fullest extent permitted by law and survives any termination of these Terms. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under Indian law.
14. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and agents from and against any claim, loss, liability, damage, or expense (including reasonable legal fees and costs of defence) arising out of your breach of these Terms, your misuse of the Platform, your violation of any applicable law, or your infringement of any third party's rights. The Company may, at its own expense, assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to reasonably cooperate with the Company's defence of that matter.
15. Relationship of Parties; No Agency
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between the Company and any User, vendor, or third-party facilitator. Where an Event or workshop is led by an independent third-party facilitator, that facilitator acts in an independent capacity, and the Company's liability in connection with such Event or workshop is governed by Section 13 above and Section 16 of the Event / Workshop / Ticketing Terms, without prejudice to any statutory right you may have as a consumer against the Company as the service provider through which the Booking was made.
16. Right to Modify or Discontinue Services
We reserve the right, at our discretion, to add, modify, suspend, or discontinue any Service, feature, menu item, event, or workshop offered on the Platform, in whole or in part, at any time. Where this affects a Booking you have already confirmed and paid for, your remedy is the treatment set out in our Refund & Cancellation Policy.
17. Force Majeure
The Company shall not be liable for any failure or delay in performance under these Terms arising from causes beyond its reasonable control, including acts of God, fire, flood, earthquake, pandemic, epidemic, war, terrorism, civil unrest, riots, strikes or labour disputes, governmental action or regulatory change, power or internet outages, or failure of third-party infrastructure, venues, performers, or Payment Partners, or any other cause beyond its reasonable control.
18. Suspension and Termination
We may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful conduct, or posed a risk to the Platform, our staff, or other Users. Termination of access does not affect any Booking already confirmed, except where the Booking itself was the basis for, or a result of, the breach.
19. Dispute Resolution and Governing Law
These Terms are governed by the laws of India. The parties shall first attempt to resolve any dispute arising out of or in connection with these Terms through good-faith negotiation by writing to admin@thecuriotable.in. If a dispute is not resolved within 30 days of such notice, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by the Company, with the seat and venue of arbitration at Bengaluru, Karnataka, and the proceedings conducted in English. Each party shall bear its own costs of the negotiation and arbitration, save as the arbitrator may otherwise direct in the final award. Nothing in this Section shall be construed to deprive a User who qualifies as a "consumer" under the Consumer Protection Act, 2019 of their statutory right to approach the appropriate consumer forum, the Data Protection Board of India, or any other authority or forum created under applicable law. Subject to the foregoing, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any matter not referred to arbitration.
20. Grievance Officer
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000 and rules made thereunder, the Company has designated a Grievance Officer to address User grievances regarding the Platform:

Grievances will be acknowledged within 48 hours of receipt and resolved within 30 days, save where additional time is reasonably required and communicated to you. For routine, non-grievance queries, please write to community@thecuriotable.in.
21. General Provisions
Severability: If any provision of these Terms is held invalid, unenforceable, or void by a court or other competent authority, that provision shall be read down to the minimum extent necessary to make it enforceable, or, if it cannot be so read down, severed, and the remaining provisions shall continue in full force and effect. Waiver: No failure or delay by the Company in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise of a right preclude any other or further exercise of it. Assignment: You may not assign or transfer your rights under these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. Notices: We may provide notices to you via email, SMS, WhatsApp, or by posting on the Platform. Headings: Section headings are for convenience only and do not affect interpretation of these Terms.
22. Entire Agreement
These Terms, together with the Privacy Policy and the specific documents referenced in Section 5, constitute the entire agreement between you and the Company in relation to your use of the Platform, and supersede all prior agreements or understandings, whether written or oral, on that subject.
23. Changes to These Terms
We may revise these Terms from time to time. The revised Terms will be posted on the Platform with an updated "Last Updated" date and, where the changes are material, we will provide reasonable additional notice. Continued use of the Platform after such changes take effect constitutes your acceptance of the revised Terms.
